Tickets Fixed Escalation sets Ticket to "Open" although the setting is "Pending"

I did set up an escalation the sets the ticket to "Pending" if the Starter replies after it was set to "Resolved".

But it sets the ticket to "Open" although if have set it up differently (see screens below)
